Class action shareholder suit against Diebold dismissed
NORTH CANTON, Ohio (9/3/08)--A class-action shareholder lawsuit filed against ATM manufacturer Diebold was dismissed Aug. 22. On Dec. 16, 2005, five shareholder lawsuits were filed against the company and its current and former officers and directors, alleging violations of federal securities laws. The cases were consolidated into a single proceeding in the U.S. District Court for the Northern District of Ohio. A separate class action suit against Diebold, filed by participants in the company’s 401(k) plan and alleging breaches of duties under the Employee Retirement Income Security Act of 1974, remains outstanding.
